Terms of Service

By accessing or using HarakaFlow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users, including individuals, businesses, and organizations ("Users") who register for or use HarakaFlow's WhatsApp automation platform.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

HarakaFlow provides a multi-tenant WhatsApp automation platform that enables businesses to send and receive WhatsApp messages programmatically via our API, manage contacts, schedule bulk messages, and monitor analytics ("the Service").

The Service is provided "as is" and is subject to the limitations and conditions described herein. HarakaFlow is not affiliated with or endorsed by WhatsApp Inc. or Meta Platforms, Inc.

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By registering, you represent that the information you provide is accurate and that you will keep it up to date.

You may not share your account credentials with third parties or use another user's account without authorization. Notify us immediately at security@harakaflow.io if you suspect unauthorized access to your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Send unsolicited messages (spam) or bulk messages to recipients who have not opted in
• Violate WhatsApp's Terms of Service or Community Guidelines
• Harass, threaten, abuse, or harm any person or group
• Distribute illegal, harmful, or offensive content
• Infringe upon intellectual property rights of third parties
• Transmit malware, viruses, or other harmful code
• Attempt to circumvent rate limits, quotas, or security measures
• Impersonate another person, business, or entity
• Engage in any fraudulent activity

Violations may result in immediate suspension or termination of your account without refund.

By using HarakaFlow, you acknowledge that all WhatsApp-based messaging is subject to WhatsApp's Terms of Service and Commerce Policy.

You are solely responsible for ensuring that your use of the Service complies with WhatsApp's policies, including obtaining proper consent from message recipients and honoring opt-out requests promptly.

HarakaFlow reserves the right to suspend accounts that receive excessive complaints, trigger spam detection, or violate WhatsApp's policies, even if no explicit violation of these Terms has occurred.

HarakaFlow offers free and paid subscription plans. Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by applicable law.

If your payment method fails, we will attempt to retry the charge. Failure to pay may result in downgrade to a free plan or suspension of your account. You are responsible for all taxes and fees applicable to your subscription.

We reserve the right to change pricing with at least 30 days' notice. If you disagree with a price change, you may cancel your subscription before the change takes effect.

Daily message limits are enforced per session as defined in your plan. Unused message quota does not carry over to the next day.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all content and data you submit to the Service. By using the Service, you grant HarakaFlow a limited license to store and process your data solely to provide the Service.

You are responsible for ensuring you have the legal right to collect and process the personal data of your contacts, including obtaining required consents under applicable data protection laws (e.g., GDPR, CCPA).

The Service, including its design, code, trademarks, logos, and documentation, is owned by HarakaFlow and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or attempt to extract the source code of the Service, without our written permission.

To the maximum extent permitted by law, HarakaFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to HarakaFlow in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. WhatsApp connectivity depends on third-party infrastructure outside our control.

You may terminate your account at any time by contacting support or through your account settings. Upon termination, your right to use the Service will cease immediately.

HarakaFlow may suspend or terminate your account at any time for violation of these Terms, with or without notice. We may also discontinue the Service at any time with 30 days' notice.

Upon termination, we will retain your data for up to 30 days, after which it may be permanently deleted. Export your data before terminating your account.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
